This Runner Agreement, Waiver, and Release (this “Agreement”) applies to individuals who are
requesting a charity registration slot for the below race through Marathon Kids (“MK”).
1. Race Details
Race Name: 131st Boston Marathon® presented by Bank of America (the “Race”)
Total Fundraising Commitment: $15,000 (or the amount you promised to commit when the application was accepted)
Fundraising Deadline: April 15, 2027
2. Fundraising Commitment and Financial Responsibility
By signing this Agreement, I understand that I am committing to donating or fundraising the
Fundraising Commitment amount. I understand that this commitment applies as soon as I sign
this Agreement – that means that even if I do not ultimately participate in the Race (due to
illness, injury, family emergency, Race cancellation, disqualification by the Race Organizers, or
any other reason), I am still responsible for meeting the Fundraising Commitment.
I agree that if I fail to meet any of the fundraising deadlines for the Race, MK can charge the
credit card I provide on GivenGain, and if MK is unable to do so, my registration may be canceled.
Furthermore, I understand that I am responsible for my own race registration fee and travel
Expenses.
3. Team Marathon Kids Fundraising & Participation Policy
By applying to run with Team Marathon Kids for the 131st Boston Marathon® presented by Bank of America, participants agree to the following fundraising and participation policies.
Fundraising Deadline
All fundraising commitments must be completed by April 15, 2027.
Team Marathon Kids and Charity Teams will send multiple reminders leading up to the deadline to help runners stay on track with their fundraising goals.
Milestones:
Unless otherwise agreed upon, charity runners are expected to hit the following fundraising milestones to ensure good standings:
January 1, 2027 - $5,000
February 1, 2027 - $7,000
March 1, 2027 - $9,000
April 15, 2027 - Full Commitment
Registration Fees
All registration fees are non-refundable, including if a participant chooses to withdraw from the race before race day.
Transfers & Deferrals
Race entries are non-transferable.
Deferrals to the following year may be considered only if the participant has met their full fundraising minimum.
Withdrawal Policy
Before December 1, 2026
Participants may withdraw from the race without any additional fees. However, fundraising donations are non-refundable.
After December 1, 2026
If a participant withdraws from the race, they are responsible for covering the $200 Team Marathon Kids Program Activation Fee, either through additional fundraising or it will be charged to the card on file.
After February 1, 2026
If a participant withdraws from the race, they remain responsible for the full fundraising commitment amount.
Full Marathon: $15,000 total fundraising commitment (or the amount you promised to commit when the application was accepted)
Participants may either:
- Continue fundraising through April 15, 2027 or
- Have the remaining balance charged to the card on file after the fundraising deadline.
4. Conduct and Compliance with Race Rules
I understand that by participating in the Race as a member of Team MK, my conduct may reflect
on MK. As such, I agree to conduct myself at all times in a manner that comports with MK's
values and conveys respect for others who organize, attend or participate in the Race. I also agree to comply with all Race Organizers' rules, regulations, and determinations.
5. Waiver and Release
I understand that the Race is a physically demanding activity and that training for and
participating in the Race involves significant physical exertion and risk of bodily injury. I attest
and certify that I am physically capable and properly trained to participate in the Race.
I understand that participation in the Race and/or any Race-related activities offered by MK
(such activities “Ancillary Race Activities”) may involve risks that may arise from a variety of
sources, including but not limited to my own actions, others’ actions, and the location of the
Race and/or the Ancillary Race Activity. I understand that these risks may result in physical or
psychological injury, pain, suffering, temporary or permanent disability, economic or emotional
loss, property loss or damage, and/or death. I understand and agree that by participating in the
Race and any Ancillary Race Activity, I knowingly and freely assume and accept all risks
associated with such participation, regardless of the cause.
In consideration of the opportunity to participate in the Race as part of Team MK, I agree to
waive and release Marathon Kids, Inc. and its directors, officers, employees, volunteers,
consultants, contractors, and agents (together, the “Released Parties”) from any and all liability,
claims, costs and damages of any kind which I, my next of kin, or my legal representatives may
have or which may later accrue, resulting or arising directly or indirectly from my participation
in the Race and/or any Ancillary Race Activities. I understand and agree that the foregoing
waiver and release includes all claims regardless of the cause, even those caused by the
negligence of the Released Parties.
6. Media and Publicity Release
I understand that organizing participation in events like the Race provides important
opportunities for MK to raise awareness of its mission. As such, I grant full permission to MK to
collect and record my name, photos, video, voice, and/or likeness in any medium in connection
with my participation in the Race and/or any Ancillary Race Activities and to use such
information or recordings in any manner and media now known or hereafter invented for MK’s
fundraising, promotional, and/or educational purposes.
I also grant MK the right to use or repurpose any content posted on my fundraising page for the
Race or that I provide in connection with this Agreement, and I give MK the right to repost,
repurpose, use or share any content connected to my participation in the Race that I post on
social media.
7. Miscellaneous
The terms of this Agreement are governed by Texas law, without regard to its choice of law
principles. I agree that the only proper jurisdiction and venue for any dispute I may have with
MK relating to this Agreement or my participation in the Race (or any Ancillary Race Activity)
is in the state or federal courts located in Austin, Texas, and I consent to the exercise of personal jurisdiction in these courts in connection with any dispute.
I confirm that I have read and that I agree to all of the terms and conditions outlined above.
