Marathon Kids, Inc. (“Marathon Kids,” “we,” “us,” or “our”) is committed to student data privacy, information security, and the systems that safeguard student personal information provided to us by schools. This policy applies solely to Marathon Kids Connect (“MKC”) digital lap tracking applications and reporting services and does not apply to the informational website located at https://www.marathonkids.org (“Marathon Kids website”).
As a part of and in addition to the following policy sections, Marathon Kids pledges to carry out responsible stewardship and appropriate use of student personal information by adopting the commitments of the Student Privacy Pledge, the Children’s Online Privacy Protection Act (“COPPA”), and the Federal Education Rights and Privacy Act (“FERPA”).
Use of Student Data
We collect, maintain, use, and share student personal information only as necessary for authorized educational or school purposes or as authorized by the parent/student.
We collect the following student personal information from our partner schools: first name, last name, student number (optional), grade, homeroom or P.E. section, and gender. In addition, our software collects data on student lap run dates, times, and distance traveled. We do not utilize any location-sharing functionality in our software to capture an individual student’s location.
This information is used to provide impact reports about physical activity minutes and mileage achieved by the students and other participants. We make these reports available to teachers, faculty. and administrators at our schools. The schools can also choose to make an individual student’s information available directly to the student and the student’s parents or legal guardians.
We disclose in contracts and privacy policies the types of student personal information we collect, and the purposes for which the information is used or shared with third parties.
We may share aggregated and anonymized information with partners and researchers, but we do not share personally identifiable information. We do not sell students personal information.
We do not build a personal profile of a student and we use a student’s personal information solely for supporting authorized educational/school purposes or as authorized by the parent/student.
In the case of any merger or acquisition of Marathon Kids, we will allow a successor entity to maintain the student personal information we have collected, provided the successor entity is subject to these same commitments for the previously collected student personal information.
Safeguarding Student Data
We maintain comprehensive security on all of our systems to protect the security, privacy, confidentiality, and integrity of student personal information against risks – such as unauthorized access or use or unintended or inappropriate disclosure – through the use of administrative, technological, and physical safeguards appropriate to the sensitivity of the information.
All of the servers that we use to store and exchange personal information use SSL Encryption.
All access to student personal information requires a password-protected account authorized by the school.
We support access to and correction of student personally identifiable information by the student or their authorized parent, either by assisting the educational institution in meeting its requirements or directly when the information is collected by Marathon Kids directly from the student with student/parent consent.
We require that our vendors with whom student personal information is shared in order to deliver educational services are obligated to implement these same commitments for any student personal information to which they have access.
We may disclose personal information when required by law or to comply with a court order or other legal process.
